|HUD is saying that there is no duty to bargain yet because no changes are yet ready to be implemented. The negative side of this type of approach (waiting until something is ready to be implemented) is that the union does not have any official input upfront (since official PDI has been declined by HUD management thru the Labor Management Forum) and there may be a very short window from notification to implementation such as occured with the Small Office Closures and the Multifamily Transformation.
As soon as any HUD employee notices that something is changing they should notify NFFE 1450 at 213-534-2705 we can can anew demand to bargain.

On 9/7/2017, HUD management declined formal engagement in pre-decisional involvement with the 3 NFFE locals.
The union needs to know about contemplated changes in work conditions and negotiate the impact and implementation of those changes.
The union has a legal right to know what the contemplated changes are in advance of management communicating with bargaining unit employees.

|09/11/2017||2017-09-11 ULP Bypass Switchboard||NFFE 1450’s role as union representative was bypassed when HUD management solicited direct comments without providing notice to the union and then compounded the problem by not providing a copy of comments received to the union. Further, HUD management censored comments that didn’t suit management’s point of view.|
